Inclusive porque o juiz que tomou essa decis\u00e3o reconhecia a gravidade do ato e mencionava esse comportamento recorrente, sugerindo a necessidade de tratamento psicol\u00f3gico e psiqui\u00e1trico.<\/div>\n<p><b style=\"font-weight: normal;\"><br \/><\/b><br \/>\n<\/p>\n<div dir=\"ltr\" style=\"line-height: 1.2; margin-bottom: 0pt; margin-left: 42.55pt; margin-top: 0pt;\">\nNo meio jur\u00eddico, por\u00e9m, as opini\u00f5es se dividiram e muitos apoiaram o juiz porque, segundo eles, a decis\u00e3o teria de ser t\u00e9cnica e, tecnicamente, aquela atitude n\u00e3o poderia ser enquadrada como estupro. Nas redes que reuniam defensores do abolicionismo penal proliferaram manifesta\u00e7\u00f5es entre ir\u00f4nicas e ofensivas aos que, igualmente antipunitivistas, deploravam a decis\u00e3o. Como se abolicionismo significasse aus\u00eancia de puni\u00e7\u00e3o, e n\u00e3o o estabelecimento de um horizonte \u2013 porque nada al\u00e9m disso \u00e9 poss\u00edvel numa sociedade de classes \u2013 na dire\u00e7\u00e3o do afastamento do direito penal como solu\u00e7\u00e3o de conflitos, o que \u00e9 algo bem diferente. Combater o punitivismo \u00e9 combater o apelo ao direito penal e ao endurecimento das penas, que \u00e9 urgente e h\u00e1 tr\u00eas d\u00e9cadas \u00e9 tend\u00eancia crescente no mundo.<\/div>\n<p><b style=\"font-weight: normal;\"><br \/><\/b><br \/>\n<\/p>\n<div dir=\"ltr\" style=\"line-height: 1.2; margin-bottom: 0pt; margin-left: 42.55pt; margin-top: 0pt;\">\nMas o \u201ctribunal do Facebook\u201d \u00e9 assim: um vasto campo no qual as pessoas extravasam suas paix\u00f5es, imediata e irrefletidamente. De modo que os identificados \u00e0 esquerda que ousaram criticar a decis\u00e3o do juiz tiveram seu car\u00e1ter posto em d\u00favida \u2013 seriam falsos antipunitivistas que finalmente se revelariam ao menor sinal de um caso moralmente conden\u00e1vel \u2013 e chegaram a ser associados \u00e0 extrema-direita, personificada no famoso deputado cuja candidatura \u00e0 presid\u00eancia vem ganhando ades\u00f5es crescentes. N\u00e3o foi s\u00f3 o argumento tosco de que sugerir interpreta\u00e7\u00e3o diferente da lei significava transgredi-la \u2013 afinal, repetiram, \u201cMoro tamb\u00e9m \u2018interpreta\u2019 a lei\u201d, como se houvesse termo de compara\u00e7\u00e3o entre as in\u00fameras ilegalidades da Lava Jato e esse caso espec\u00edfico \u2013, n\u00e3o foi s\u00f3 a pecha de \u201cesquerda punitiva\u201d, que estaria, para todos os efeitos, assimilada \u00e0 extrema-direita: foi principalmente o zelo na discuss\u00e3o estrita da t\u00e9cnica, do enfoque \u201cl\u00f3gico-racional\u201d \u00e0 luz da \u201cdogm\u00e1tica penal\u201d, como se o direito fosse um mundo \u00e0 parte, alheio \u00e0 vida cotidiana. Foi um preciso exemplo de oculta\u00e7\u00e3o dos conflitos sociais atrav\u00e9s da oculta\u00e7\u00e3o do debate pol\u00edtico sobre eles, que, no dizer de Nilo Batista, encontra \u201cna mais bisonha e elementar linguagem jur\u00eddico-penal seu melhor instrumento\u201d. Como no exemplo do debate sobre a quest\u00e3o agr\u00e1ria, reduzido \u201ca umas tantas quest\u00f5es muito singelas: houve esbulho possess\u00f3rio?
